General Terms and Conditions of Sale – Europe-Connection

Last updated: 6 October 2026. This version applies to new orders placed from the date of its publication.

Preamble – Identification of the operators

Identification of the contracting party and previous orders

The Customer is informed of the identity and contact details of their seller or service provider before committing and before making any payment. This identity is repeated in the Order confirmation and on the invoice. Europe-Connection is the trading name; it does not replace the legal name of the contracting party.

The identified seller or service provider is responsible for the obligations arising from its contract, including delivery, refunds, after-sales service and applicable guarantees. Handling an enquiry through the European contact does not change that identity.

Orders concluded before this update remain subject to the terms accepted when they were placed and to the obligations of the original seller. Publication of these Terms does not, by itself, transfer contracts or their obligations to another company.

These General Terms and Conditions of Sale, hereafter the “Terms”, govern orders placed through www.europe-connection.com and, where expressly provided, orders, quotations and services arranged through customer service.

They apply to Consumer Customers and, subject to the specific provisions set out below, to Business Customers.

These Terms, the information on the Product page, any special terms applicable to customised or specific Products, the order summary, the order confirmation and, for Business Customers, the accepted quotation or purchase order together constitute the applicable contractual documents.

Before confirming an Order, the Customer is invited to read these Terms and, when ordering a Product identified as customised or specific, the corresponding special terms.

Confirmation of the Order requires express acceptance of these Terms through the mechanism provided on the Website.

The applicable Terms are those accepted by the Customer at the time of the Order. Any subsequent amendment applies only to future orders.

Article 1 – Definitions

For the purposes of these Terms:

  • Customer: any individual or legal entity placing an Order.
  • Consumer Customer / Consumer: any individual acting for purposes outside their trade, industrial, craft, professional or agricultural activity.
  • Business Customer / Business: any individual or legal entity acting for purposes within their business or professional activity.
  • Order: a contractual commitment concerning one or more Products or Services selected by the Customer and confirmed in accordance with the ordering process.
  • Product: any tangible goods offered on the Website, including surveillance, counter-surveillance, security or electronic equipment and their accessories.
  • Customised Product: a Product modified, manufactured, integrated or adapted to the Customer’s individual specifications under the conditions defined in Article 16.
  • Service: any invoiced service, including integration, modification, configuration, assistance, documentation, installation, logistics or an additional commercial warranty.
  • Seller or Service Provider: the company identified before the contract is concluded, in accordance with the preamble. In these Terms, Europe-Connection refers to the trading name under which that company operates, without changing the allocation of obligations between the companies.
  • Website: the website accessible at www.europe-connection.com.
  • Spectra: the customer service assistant or interface made available, in particular, to facilitate tracking of Orders, after-sales requests, guarantees and withdrawals.

Article 2 – Purpose, legal capacity and lawful use of Products

These Terms define the rights and obligations of the relevant seller or service provider and the Customer in relation to Orders.

The Customer declares that they have the legal capacity required to enter into the contract.

Depending on their nature and use, the Products offered may be subject to specific regulations. Possession of a Product does not confer any right to use it contrary to applicable laws and regulations.

The Customer must ensure that the intended use of the Product is permitted in the country and circumstances in which it will be used.

In particular, depending on the Products concerned, the Customer undertakes not to:

  • unlawfully infringe another person’s privacy;
  • record or monitor a person where their consent or an authorisation is legally required;
  • unlawfully intercept correspondence or communications intended for third parties;
  • access an information system without authorisation;
  • use radio frequencies, transmission powers or equipment requiring authorisation in breach of applicable regulations;
  • use Products to prepare, facilitate or commit an offence;
  • unlawfully circumvent security or protection mechanisms;
  • use a Product in a manner that infringes a third party’s rights.

Public authorities, security forces, investigation professionals and other organisations with specific powers remain required to comply with the legal framework and authorisations applicable to their activities.

The seller or service provider cannot be held responsible for the Customer’s misuse of a Product or use in breach of regulations, without prejudice to the legal obligations that remain incumbent on the seller or service provider.

Article 3 – Products and pre-contractual information

The essential characteristics of Products are presented on their respective Product pages. The Customer is invited to consult them before ordering and to contact customer service when a characteristic is decisive for their purchase and requires specific confirmation.

Depending on the Product, the page may specify functions, relevant dimensions, power supply, indicative battery life, resolution, recording capacity, communication modes, software compatibility, included accessories, manufacturing or preparation time, customisation and available options.

The essential characteristics agreed at the time of the Order form part of the contract.

Product availability shown on the Website may refer, depending on the circumstances, to availability of the finished Product, of the components needed to manufacture it, or to the ability to carry out the configuration ordered.

For Customised Products, the finished Product may be manufactured or modified only after the Order is confirmed.

Article 4 – Prices

Prices offered to Consumer Customers on this English-language Website are displayed in pounds sterling (GBP), inclusive of applicable taxes where VAT applies. The currency and total payable are shown before the Order is confirmed.

The applicable price is the price displayed when the Order is placed, subject to an obvious pricing error.

Delivery or preparation charges and additional services not included in the Product price are disclosed to the Customer before final confirmation of the Order.

Prices may be changed at any time for future Orders.

Promotions are valid during the period in which they are displayed and, where they concern limited stock, while the relevant quantities remain available.

For deliveries within the European Union, VAT is applied in accordance with the tax rules applicable to the transaction and the destination country.

For deliveries to countries or territories outside the applicable tax territory, customs duties, import taxes or local charges may be requested by the authorities or intermediaries in the destination country. Where not expressly included in the displayed price, these duties or taxes are payable by the Customer.

The Customer is responsible for the accuracy of the tax and delivery information they provide.

Article 5 – Orders

5.1 Ordering process

The legal identity and contact details of the seller or service provider are presented to the Customer before final confirmation and before any payment. Another company cannot replace the contracting party after the Order solely through the issue of an invoice.

The Customer selects the desired Products and, where available, their options or customisations.

Before final confirmation, the Customer is given a summary allowing them to check, in particular, the selected Products, options, quantities, prices, applicable charges and delivery and billing details. They must correct any error before confirming the Order.

The function used to confirm the Order clearly indicates that it entails an obligation to pay.

5.2 Acceptance of the terms

Confirmation of the Order requires acceptance of these Terms.

When a customised or specific Product is ordered, the Customer is also informed before payment of the special terms applicable to that category of Product.

The acceptance checkbox may, in particular, contain the following wording:

“I have read and accept the General Terms and Conditions of Sale and the terms applicable to customised or specific products. I acknowledge that I have been informed that products identified as customised or specific are not eligible for the right of withdrawal when the legal conditions for that exception are met. I undertake to use the products ordered in accordance with applicable legislation and with respect for third parties’ rights.”

This acceptance is mandatory to complete the Order.

5.3 Confirmation

After the contract is concluded, an Order confirmation is sent to the Customer on a durable medium, in particular by email.

This confirmation provides, on a durable medium, the identity of the seller or service provider, the applicable contractual information and the accepted Terms. Where the Consumer Customer has a right of withdrawal, the information needed to exercise it and the model withdrawal form are also provided on a durable medium in accordance with regulations.

5.4 Refusal or cancellation of an order

An Order may be refused or cancelled for a legitimate reason, including a payment incident, fraud or serious suspicion of fraud, manifestly incorrect information, technical impossibility of carrying out the requested customisation, permanent unavailability of the Product or its components, a legal, regulatory, customs or export restriction, an Order involving a use that is manifestly unlawful, or a previous dispute relating to payment of an Order.

Where payment has already been collected and the Order is definitively cancelled without any amount being legally retainable, the corresponding sums are refunded.

Article 6 – Payment

The price is payable using the methods offered at the time of the Order. These may include bank card, bank transfer, cheque, cryptocurrency where offered, or any other method displayed on the Website.

6.1 Bank card

Card payments are processed through a secure interface provided by the payment service provider. The seller does not necessarily have access to the Customer’s complete banking details.

6.2 Bank transfer

When bank transfer is selected, the details needed for payment are supplied to the Customer. Final preparation of the Order may be conditional on actual receipt of the funds.

6.3 Cheque

Where payment by cheque is offered, the cheque must be sent in accordance with the instructions supplied to the Customer. Cash must never be sent by post.

The seller may wait for actual clearance or the necessary bank checks before starting preparation or dispatch.

6.4 Cryptocurrencies

Where payment in cryptocurrency is offered, the contractual price remains expressed in the currency displayed and confirmed for the Order, namely GBP on this Website, and conversion is carried out according to the conditions displayed by the payment provider or system at the time of the transaction.

Where a refund is legally required, it is made in accordance with the applicable rules and, where refunding through the original payment method is technically impossible, by a method agreed with the Customer that does not impose unjustified charges on them.

6.5 Deferred payments and reservation

For payment methods that do not result in immediate collection, including bank transfer or cheque, the Order may be recorded pending payment.

Unless otherwise indicated to the Customer, the corresponding Products or components may be reserved for 10 calendar days.

If payment is not received within that period, the reserved Products or components may be released. Payment received after that period no longer guarantees their initial availability.

The seller may then confirm a new timeframe, propose an equivalent solution with the Customer’s agreement, or refund the sums received where the Order cannot be fulfilled.

6.6 Retention of title

Where the seller is the legal owner of the Product sold, it remains the seller’s property until all sums due have been paid in full.

Transfer of risk to the Consumer Customer remains governed by the applicable mandatory provisions and, in particular, Article 10 of these Terms.

Article 7 – Consumers’ right of withdrawal

7.1 Principle

Subject to the exceptions provided by law, the Consumer Customer has fourteen (14) days to exercise their right of withdrawal without having to give a reason.

For a sale of goods, this period generally runs from receipt of the Product by the Customer or by a third party designated by them other than the carrier.

Where a single Order comprises several goods delivered separately, the applicable period runs from receipt of the last item, lot or part where regulations so provide.

Where the final day falls on a Saturday, Sunday, public holiday or non-working day, the period is extended to the next working day in accordance with the applicable legal rules for calculating time limits.

7.2 Exercising withdrawal

The Customer may exercise withdrawal by any clear and unambiguous statement expressing their decision to withdraw.

To speed up processing, Europe-Connection recommends using the electronic function provided on the Website and/or Spectra.

Use of Spectra is optional and is not the only valid way to exercise the right of withdrawal.

The Customer may, in particular, submit their request through the Website’s electronic withdrawal function, by email to service-clients@europe-connection.fr, by post, using the form at the end of these Terms, or by any other means that unambiguously expresses their decision.

The Customer must be able to establish that they exercised their right within the applicable period.

7.3 Electronic withdrawal function

Where required by regulations, Europe-Connection makes available to the Consumer Customer, during the applicable statutory period, a free, visible, directly and easily accessible function for withdrawing online.

This function enables the Customer to identify the relevant Order and expressly confirm their decision. An acknowledgement is sent on a durable medium and contains the information required by regulations, including the content of the statement and the date and time of its submission.

7.4 Returning the Product

After notifying withdrawal, the Customer returns the Product without undue delay and no later than fourteen (14) days after that notification, to the return address specified for the relevant Order. The postal complaints contact in Article 20 remains available for notifying withdrawal.

The Customer is invited to return the Product, its accessories, the items delivered with it and, where possible, its original packaging.

The absence or opening of the original packaging does not, by itself, extinguish the right of withdrawal.

7.5 Diminished value of the Product

The Customer may handle the Product to the extent necessary to establish its nature, characteristics and functioning.

They may, however, be liable for diminished value resulting from handling beyond what is necessary for that assessment. Any amount retained must correspond to the actual loss of value established and is not an automatic penalty.

7.6 Sensitive technical Products and security seals

Given the technical nature of certain Products, Europe-Connection may affix a security seal or label to the Product or its packaging.

This mechanism helps establish whether a Product has been opened or dismantled after preparation.

Breaking the seal does not automatically extinguish the right of withdrawal where no legal exception applies.

It may, however, justify a technical inspection of the Product to determine its condition and check, in particular, for:

  • dismantling;
  • electronic modification;
  • wiring modification;
  • modification, removal or replacement of firmware or software;
  • a substantial configuration change;
  • damage;
  • work on internal components;
  • or, more generally, handling beyond what is necessary to assess the Product normally.

Where an actual loss of value is established and attributable to such handling, a deduction for diminished value may be made in accordance with the French Consumer Code and the applicable mandatory consumer protection rules.

Europe-Connection may prepare a technical, photographic or documentary report describing its findings.

No deduction for diminished value will be applied solely because a label has been broken where this has caused neither alteration nor a loss of value legally attributable to the Customer.

7.7 Return costs

Unless Europe-Connection voluntarily covers them or a legal provision requires otherwise, the direct costs of returning goods following withdrawal are borne by the Customer where they were informed of this beforehand.

As part of its commercial Buyer Protection programme, Europe-Connection may offer coverage or commercial compensation for return costs for certain returns from mainland France.

Where this coverage is offered as a voucher, it is an additional commercial benefit and does not replace refunds that must legally be made in the manner required by law.

7.8 Refunds

Where withdrawal is validly exercised, the seller refunds all sums paid, including the initial standard delivery charges, no later than fourteen (14) days after being informed of the Customer’s decision, subject to the permitted deferral below for sales of goods.

For sales of goods, Europe-Connection may withhold the refund until it has received the Product back or the Customer has supplied sufficient evidence of dispatch, whichever occurs first.

The refund is made using the same payment method as the original transaction, unless the Customer expressly agrees to another method that incurs no charges for them.

Where the Customer selected a delivery method more expensive than the standard delivery offered, Europe-Connection is not required to refund the corresponding additional cost.

7.9 Statutory exceptions

In accordance, in particular, with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised in the cases provided by law. Where UK mandatory law applies, the relevant exceptions are those under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including goods made to the consumer’s specifications or clearly personalised.

These may include:

  • goods made to the consumer’s specifications or clearly personalised;
  • goods liable to deteriorate or expire rapidly;
  • goods unsealed after delivery that cannot be returned for health protection or hygiene reasons;
  • goods inseparably mixed with other items;
  • audio or video recordings or computer software unsealed after delivery;
  • certain digital content not supplied on a tangible medium where performance has begun after the Customer’s express consent and acknowledgement of the loss of the right of withdrawal;
  • services fully performed before the withdrawal period expires where the statutory conditions for loss of that right have been met.

Simply opening an electronic device is not, by itself, a general exception to the right of withdrawal.

Customised Products sold by Europe-Connection are governed more specifically by Article 16.

Article 8 – Business Customers and B2B sales

For sales, quotations and services intended for businesses, the seller or service provider is identified before the contract is concluded, in the offer, quotation or purchase order. INTELLIS CONSEIL handles business transactions it concludes in its own name. Where a transaction is concluded with EUROPE CONNECTION FZE LLC, that company remains the Business Customer’s contracting party.

The provisions of the French Consumer Code reserved for consumers do not apply to Orders placed by a Business Customer unless a specific statutory extension applies.

In particular, a B2B Order concluded at a distance in the normal course of the Customer’s business does not automatically benefit from the fourteen-day right of withdrawal reserved for consumers.

This provision is subject, in particular, to the special regime that may benefit certain Business Customers employing five people or fewer for certain off-premises contracts where the subject matter falls outside their main business activity.

Subject to those qualifications, a business Order becomes binding in accordance with the applicable confirmation and payment conditions.

The relevant seller or service provider may, exceptionally and as a commercial gesture, agree to cancel a business Order.

Where cancellation is accepted after procurement, manufacturing, modification, administrative or logistical costs have already been incurred, the parties may agree compensation intended to cover those costs.

Where provided for in the cancellation agreement, this compensation may amount to 20% of the Order value, depending on progress and costs actually incurred.

This provision does not limit any mandatory rights applicable in the event of a defective Product, non-conformity, a defect covered by an applicable guarantee, or non-performance attributable to the seller or service provider.

Article 9 – Disbursements, purchasing mandate and services

9.1 Principle

For transactions expressly handled under the disbursement regime (“débours”), the Customer authorises the relevant seller or service provider to acquire, in the Customer’s name and on their behalf, certain Products, housings or components needed to fulfil the Order.

The Customer accepts this mandate when confirming the Order.

Sums classified as disbursements correspond to the exact amount paid to a third-party supplier on the Customer’s behalf, without any margin applied to those sums.

Application of the disbursement regime requires compliance with the applicable legal, tax and accounting conditions.

9.2 Work performed

Within this framework, the seller or service provider may, in particular, source the appropriate Product or component, order it on the Customer’s behalf, organise its transport, receive it where necessary for the service, integrate, modify or prepare it, and then hand over or dispatch the final Product to the Customer.

Where required by the applicable regime, supplier documents identify the Customer as the beneficiary of the purchase or show that the purchase is made in the Customer’s name and on their behalf.

9.3 Amount of disbursements

The amount recorded as a disbursement corresponds to the exact cost incurred on the Customer’s behalf.

The supporting documents needed to establish the nature and amount of the expenditure are retained, and sums are recorded in accordance with the rules applicable to clearing accounts.

Disbursements do not constitute remuneration of the seller or service provider where the legal conditions for that classification are met.

9.4 Paid services

Remuneration corresponds to the Services actually provided to the Customer. These may include:

  • sourcing and procurement management;
  • integration of a camera or microphone;
  • dismantling and reassembly of a housing;
  • machining or drilling;
  • wiring;
  • electronic modifications;
  • configuration;
  • documentation in French;
  • technical assistance;
  • installation;
  • logistical preparation;
  • Order management;
  • after-sales service;
  • commercial warranty services;
  • and any other service disclosed to the Customer.

9.5 Information and invoicing

The total amount presented to the Customer before confirmation of the Order is the amount they undertake to pay.

Where an Order combines disbursements and services, a detailed summary may distinguish sums incurred in the Customer’s name and on their behalf, invoiced services and legally applicable taxes.

Supporting and accounting documents are issued in accordance with applicable rules.

Where the legal conditions of the disbursement regime are not met for a particular transaction, the legally required accounting and tax treatment applies; no classification stated in these Terms can override a mandatory provision.

9.6 Example

For illustration only, an Order for an integrated device may comprise the exact cost of a camera acquired on the Customer’s behalf, the exact cost of the housing acquired on their behalf, and a service covering integration, adaptation of the housing, documentation, assistance and associated services.

The actual breakdown depends on the Order and the corresponding supporting documents.

Article 10 – Delivery

10.1 Address

Delivery is made to the address supplied by the Customer during the Order. The Customer is responsible for the accuracy and completeness of the information provided.

10.2 Timeframes

The applicable delivery date or timeframe is disclosed to the Customer when ordering, on the Product page, in the summary or in the corresponding confirmation.

For a Customised Product, the timeframe may include a manufacturing or integration period.

Unless otherwise specified, the Product is delivered without undue delay and no later than the deadline provided by the applicable mandatory provisions.

10.3 Delay

In the event of a delivery delay, the Consumer Customer has the rights provided by the French Consumer Code and any applicable mandatory consumer protection rules, including, where the statutory conditions are met, the right to require Europe-Connection to deliver within an appropriate additional period and then to terminate the contract.

Where the agreed date is an essential condition of the contract and the statutory conditions are met, the Customer may benefit from provisions allowing termination without an additional period.

10.4 Transfer of risk

Where the carrier is offered or chosen as part of the seller’s delivery arrangements, the risk of loss of or damage to the Product passes to the Consumer Customer when they, or a third party designated by them other than the carrier, take physical possession of the Product.

Any recourse the seller may have against the carrier is independent of the Consumer Customer’s rights.

10.5 Damaged parcel

The Customer is invited to check the condition of the parcel upon receipt.

Where damage is visible, they are advised to record precise reservations with the carrier or, where justified, refuse the parcel, and promptly notify Europe-Connection or INTELLIS CONSEIL according to the seller identified in the Order.

Where a parcel has been left without personal handover, the Customer is invited to report any damage as soon as it is discovered.

These recommendations facilitate recourse against the carrier, but failure to follow them does not deprive the Consumer Customer of their statutory rights.

10.6 Lost parcel

Where the seller remains legally responsible for transport and a parcel is declared lost, the seller implements the remedies provided by applicable regulations, independently of any recourse against the carrier.

Article 11 – Statutory guarantees and commercial warranty

Statutory guarantees and consumer rights apply independently of any commercial warranty offered.

Under French law, the Consumer Customer benefits, in particular, from the statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code and the statutory guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

Mandatory rights in the Customer’s country

The French-law information below does not replace or limit mandatory consumer rights applicable in the Customer’s country. In particular, where UK consumer legislation applies, the Customer retains their rights concerning goods that are faulty, not as described or unfit for purpose, including rejection, repair, replacement, a price reduction or a refund as provided by that legislation. Expiry of a commercial warranty does not extinguish those statutory rights.

French statutory information – Guarantee of conformity

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity when a lack of conformity appears. During this period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.

Where the sale contract provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that content or service throughout the agreed supply period. During that period, the consumer need only establish the existence of the lack of conformity affecting the digital content or service, not when it appeared.

The statutory guarantee of conformity requires the business, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The guarantee entitles the consumer to repair or replacement within thirty days of their request, free of charge and without significant inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:

  1. The business refuses to repair or replace the goods;
  2. Repair or replacement takes place after thirty days;
  3. Repair or replacement causes significant inconvenience to the consumer, in particular where they permanently bear the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
  4. The lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or termination where the lack of conformity is so serious that it justifies immediate price reduction or termination. In that case, the consumer need not first request repair or replacement.

The consumer is not entitled to terminate the sale where the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights described above arise from Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who obstructs the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee entitles them to a price reduction if they keep the goods, or a full refund in exchange for returning them.

11.1 Making a claim

The seller identified before the Order is concluded is responsible for lack of conformity under the conditions provided by law. Requests are addressed to that company, directly or through the European customer service contact in Article 20. Guarantees applicable to B2B sales are claimed against the relevant business contracting party.

Where the Consumer Customer benefits from the statutory guarantee of conformity, they may request conformity through repair or replacement under the conditions provided by the French Consumer Code, without prejudice to any other applicable mandatory rights.

Goods with digital elements also benefit from the conformity and update rules where applicable.

11.2 Commercial warranty

In addition to statutory guarantees, certain Products may benefit from a commercial warranty. Its duration is specified on the Product page, in the Order or in the corresponding warranty document.

Depending on the model, a commercial warranty of at least 12 to 24 months may be offered without additional charge.

For certain Products, a paid commercial extension of up to 7 years may be offered. Where an extension must be purchased before delivery, this condition is specified when it is offered.

A commercial warranty neither reduces nor replaces statutory guarantees.

11.3 Commercial warranty exclusions

Without prejudice to mandatory statutory guarantees, the additional commercial warranty may exclude, in particular:

  • damage caused by use manifestly contrary to the instructions;
  • damage caused by a fall, impact, breakage or immersion where the Product is not designed for it;
  • normal wear and tear;
  • consumables and wearing parts, where this exclusion applies;
  • damage directly caused by unauthorised work or repair;
  • hardware or software changes that directly caused the failure;
  • cosmetic deterioration resulting from normal use.

A commercial warranty exclusion is not applied where it would remove a right under a mandatory statutory guarantee.

11.4 After-sales returns

To speed up processing, the Customer is invited to open their case through Spectra.

Using Spectra does not deprive the Customer of the option to contact customer service by email or through the other contact details in these Terms.

Where a claim falls under a statutory guarantee requiring a remedy free of charge, the Customer does not permanently bear the costs necessary to restore conformity.

Where a Product is returned as allegedly defective and inspection establishes that no covered defect exists or that the damage results from a cause excluded from the commercial warranty, a quotation may be offered for work not covered.

No cost described as a warranty charge may be applied where it would make the consumer bear an expense that must legally remain the seller’s responsibility.

Article 12 – Liability, fraud prevention and use of equipment

The seller or service provider is responsible for performing its obligations under the conditions provided by law.

No provision of these Terms is intended to remove or limit a mandatory right of the Consumer Customer.

The seller or service provider cannot, however, be held responsible for damage directly attributable to unlawful use of a Product, use contrary to the instructions supplied, an unauthorised modification that causes the damage, inappropriate installation by a third party, use incompatible with the advertised characteristics, or fault on the part of the Customer or a third party.

The Customer remains responsible for their use of the equipment and for obtaining the necessary authorisations.

Where unlawful or wrongful use of a Product by the Customer directly and demonstrably causes damage to the seller, service provider or their personnel, or gives rise to their liability towards a third party, the relevant entity retains the right to seek compensation for the actual loss suffered under the applicable general law.

Any costs or damages are not automatically payable: their existence, attribution and amount are assessed in accordance with the applicable legal rules.

For certain Orders involving a high value, a particular payment method, a destination or characteristics requiring security or fraud prevention checks, strictly necessary additional information or supporting documents may be requested.

These checks are carried out in accordance with applicable data protection regulations and, where applicable to the transaction, any specific anti-fraud or anti-money-laundering regulations.

Article 13 – Presentation of Products and confidentiality of housings

Europe-Connection sells, in particular, equipment in which a camera, microphone, electronic module or other technical device is integrated into an external housing.

This housing may be a commercially available object or a housing specifically selected to allow integration of the device.

For reasons including confidentiality of certain equipment, changes in available housing models, variations between industrial production batches or the need to adapt the housing for technical integration, the external appearance of the housing delivered may differ slightly from the photographs.

These differences may concern an aesthetic detail, a finish, a colour shade, a secondary feature of the housing or a minor variation in shape or size.

They must not, however, alter the agreed essential characteristics, advertised performance or main functions of the Product.

For integrated equipment, the essential technical element is, depending on the Product, the camera, microphone, communication module, recording system or integrated electronic device.

The contractually advertised characteristics, such as resolution, battery life, connectivity, recording mode, functions and technical capabilities, remain applicable.

Where the exact appearance of the housing is a decisive characteristic for the Customer, they are invited to specify this before manufacture or use the customisation field provided. Europe-Connection can then confirm whether the Order can be fulfilled with the desired housing.

This clause does not authorise delivery of a Product with essential characteristics different from those agreed.

Article 14 – Website security

Europe-Connection implements technical and organisational measures intended to protect the information processed on the Website.

Communications through the Website may, in particular, benefit from suitable encryption protocols. Card payments are processed through the secure systems of the relevant payment providers.

As no computer system can guarantee absolute security, Europe-Connection implements measures appropriate to the risks in accordance with applicable obligations.

Article 15 – Intellectual property

Texts, photographs, illustrations, logos, graphic elements, descriptions, documents, videos and, more generally, the Website’s original content are protected by applicable intellectual property rights.

Unless authorised or permitted by a statutory exception, their reproduction, communication to the public, extraction, adaptation or commercial exploitation, in whole or in part, is prohibited.

Access to the Website does not confer any intellectual property rights in protected elements on the Customer.

Third-party trademarks, names and signs remain the property of their respective owners.

Article 16 – Customised, specific and made-to-order Products

16.1 Principle

Certain models offered by Europe-Connection are equipment subject to individual modification, integration or manufacture after the Order.

The relevant Products are identified as customised or specific on the Website and/or in the dedicated list available at:

https://www.europe-connection.com/custom-made-specialized-product-or-service.html

For these models, Europe-Connection does not necessarily merely resell a finished, pre-manufactured device.

A commercially available object or housing may be selected and then modified to incorporate the technical device corresponding to the Customer’s Order.

16.2 Examples of housings

Depending on the model, the housing may be a clock, socket, power strip, charger, detector, speaker, soft toy, water bottle, humidifier, artificial plant, calculator, decorative object, electrical appliance or any other housing capable of accommodating the device ordered.

This list is illustrative only.

16.3 Integrated devices

Modification may, in particular, involve integrating a camera, microphone, Wi-Fi module, GSM, 4G or other module, battery, converter or power supply system, recording device, mounting support, antenna or any component required for the configuration.

16.4 Customer customisation field

For the relevant Products, Europe-Connection may provide a customisation field containing, in particular, the following information:

“Customise your spy camera to suit your needs! Enter your preferences here (position, housing colour, specific options). Our technicians will review your request and carry out the customisation where possible.”

The Customer can use it to specify their particular requirements.

These may concern the position of the device, lens orientation, viewing direction, lens position, microphone placement, housing colour or type, desired battery life, battery, power supply type, connections, component layout, concealment constraints or a particular technical adaptation.

16.5 Physical modification

Fulfilling the customised Order may require, in particular:

  • opening or dismantling the housing;
  • drilling;
  • cutting;
  • machining;
  • creating an optical opening;
  • creating an acoustic opening;
  • installing mounting supports;
  • moving or removing original components;
  • wiring or rewiring;
  • gluing or permanently fixing components;
  • integrating an additional battery;
  • modifying the power supply;
  • installing a converter;
  • adapting the internal layout;
  • adjusting lens orientation;
  • adjusting the field of view;
  • or any other operation needed for the configuration.

16.6 Technician involvement

Where necessary to manufacture the Product correctly, a Europe-Connection technician may contact the Customer after the Order and before or during manufacture.

The technician may, in particular, confirm with the Customer the direction in which the housing will be installed, the area to be covered, desired orientation, camera position, microphone placement, available power supply, expected battery life, battery location, dimensions or installation constraints, or any other useful information.

Information confirmed by the Customer may then be incorporated into the manufacturing specifications for their individual unit.

16.7 Options and variants displayed on the Website

To simplify ordering, certain possibilities may be offered as options, variants, drop-down lists, configurations or predefined choices.

The presence of an option on the Product page does not necessarily mean that a finished Product in that configuration already exists in stock.

For customised models, the Customer’s choices may determine the technical operations carried out after their Order.

The legal classification of a Customised Product depends on the actual characteristics of the Order and the work genuinely carried out to meet the Customer’s specifications, rather than merely on the presence of the Product or its variant in the catalogue.

16.8 Manufacture of each unit

For the relevant models, each Order results in individual preparation or modification.

Two Customers ordering the same commercial model may therefore receive units that have undergone different integration work depending on their housing, options, requested orientation, power supply, battery, device position or other specifications.

16.9 Physically irreversible changes and inability to return to standard stock

Certain modifications are irreversible or cannot be undone without damaging or modifying the Product again.

This may apply, in particular, to a hole drilled in a housing, cutting, machining, fastening, gluing, particular wiring, integration of a component or modification of an internal structure.

Once manufactured for a particular Order, the Product generally cannot be restored to the industrial condition of its original housing.

It may also be unsuitable for resale as a standard new Product to another Customer without dismantling, restoration or further modification.

This circumstance is physical evidence of customisation, but does not replace the statutory criteria for applying the exception to the right of withdrawal.

16.10 Prior information

The Customer is informed that the Product is customised before confirming the Order.

They are asked to read these Terms, the Product page, the page concerning customised or specific Products, and the exclusion of the right of withdrawal where the statutory conditions are met.

16.11 Right of withdrawal

Under Article L.221-28(3) of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised. Where UK mandatory law applies, the corresponding exception is provided by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This exclusion is applied where, in light of the relevant Order and the work actually carried out, the Product meets the corresponding statutory criteria.

Merely preparing a Product after an Order is not, by itself, sufficient to establish this exception.

However, where a Product is genuinely manufactured, drilled, modified, integrated or adapted to meet the Customer’s individual specifications under the conditions described above, Europe-Connection may apply the statutory exception for personalised goods.

16.12 Traceability

To enable technical tracking of manufacture and, where appropriate, substantiate the customisation carried out, Europe-Connection may retain, in particular, the selected options, the content of the customisation field, the Customer’s instructions, exchanges with the technician, component references, the chosen configuration, technical operations performed and, where necessary, photographs or technical information relating to manufacture.

These records are retained in accordance with data protection rules and for a period justified by performance of the contract, guarantees, legal obligations or the defence of the parties’ rights.

16.13 Guarantees

Any absence of a right of withdrawal for a Customised Product never removes the applicable statutory guarantees.

A Customised Product with a lack of conformity or a covered defect remains eligible for the remedies required by regulations.

Article 17 – Personal data

INTELLIS CONSEIL is the controller for processing it determines for publishing the Website and handling enquiries it manages. EUROPE CONNECTION FZE LLC is the controller for processing it determines for its Orders and services. For each transaction, the seller or service provider processes the data necessary to perform its contract. This processing complies with the General Data Protection Regulation, the French Data Protection Act and other applicable provisions. The legal notice and privacy policy supplement this information.

17.1 Purposes

Data may be used, in particular, for creating the Customer account, Orders, Product customisation, invoicing, disbursements and purchases made in the Customer’s name where that system applies, preparation and delivery, payment, fraud prevention, customer service, after-sales service, guarantees, complaints, accounting, tax or regulatory obligations, security, establishing, exercising or defending rights, and commercial communications where regulations permit.

17.2 Legal bases

Depending on the processing, its legal basis may be performance of the contract, pre-contractual steps, compliance with a legal obligation, the controller’s legitimate interests or consent where required.

17.3 Recipients

Data is accessible only to people and service providers who need to know it.

Depending on the Order, certain information may be shared with payment providers, carriers, logistics providers, suppliers from whom purchases are made on the Customer’s behalf, hosting and IT providers, customer service providers, advisers and accounting professionals, and administrative or judicial authorities where required by law.

Customers’ personal data is not sold.

17.4 International transfers

Performance of an Order concluded with EUROPE CONNECTION FZE LLC, located in the United Arab Emirates, or the involvement of a supplier or service provider outside the European Economic Area may involve processing or international transfer of strictly necessary data. The recipients, countries concerned and applicable safeguards are specified in the privacy policy.

Where required by regulations, appropriate safeguards or legal mechanisms are implemented to govern those transfers.

17.5 Retention periods

Data is retained for a period proportionate to its purpose.

Customer service exchanges may be deleted when no longer needed. They may, however, be retained or archived for longer where necessary for Product tracking, a guarantee, a complaint, a dispute, the defence of rights or compliance with a legal obligation.

Accounting documents and supporting records are retained for the legally applicable period, which may, in particular, reach 10 years.

For electronically concluded contracts whose value reaches the French regulatory threshold of €120, the contract is archived for the legally prescribed period, including ten years under the conditions laid down by the French Consumer Code.

17.6 Deletion requested by the Customer

The Customer may request deletion of their account, conversations and personal data no longer needed after the Order has been fully processed.

This request does not result in deletion of information whose retention remains necessary for compliance with a legal obligation, accounting, guarantees, justified fraud prevention, or establishing, exercising or defending legal claims.

The relevant data may then be archived with restricted access until the legitimate retention period expires.

17.7 Security

Technical and organisational measures are implemented to ensure a level of security appropriate to the risks. These may include encryption, access control, authentication, segregation, backups, limiting access rights and secure deletion procedures.

Reference to a particular technology does not constitute an absolute guarantee against any IT incident.

17.8 Customer rights

Under the conditions provided by regulations, the Customer may exercise, in particular, rights of access, rectification, erasure, restriction, objection, portability where applicable, and withdrawal of consent where processing relies on consent.

Requests may be addressed using the contact details in these Terms.

The Customer may also lodge a complaint with the CNIL or another competent data protection supervisory authority under the applicable rules.

17.9 Authorities

Available information may be disclosed where required by a legal provision, an official requisition, a court decision or a legally binding administrative request.

Disclosure is limited to the information necessary for the relevant request.

17.10 Cookies

The Website may use cookies or trackers strictly necessary for its operation.

Trackers requiring the user’s consent are used only after it has been obtained under the legally required conditions.

The Customer can manage their choices through the interface provided on the Website. A privacy policy and/or cookie policy may supplement this Article.

Article 18 – Force majeure

Neither party may be held liable for a failure resulting from an event meeting the legal criteria for force majeure.

During a force majeure event, performance of the obligations prevented is suspended to the extent necessary.

The Customer is informed where the event significantly affects fulfilment of their Order.

Where the impediment becomes permanent or the statutory conditions for termination are met, the contract may be terminated in accordance with applicable provisions.

Sums corresponding to services definitively not performed are then handled in accordance with the applicable legal rules.

Article 19 – Evidence and archiving

Computer systems, technical logs, electronic confirmations, Order data and other records retained under conditions reasonably ensuring their integrity may be used as evidence under applicable law.

This provision does not deprive the Customer of their right to produce any admissible evidence.

Electronically concluded contracts are archived where required by regulations.

For electronic contracts with a value equal to or exceeding the French regulatory threshold of €120, archiving is carried out for the applicable statutory period.

The Customer may request access to the archived contract under the conditions provided by regulations.

Article 20 – Customer service, complaints and after-sales service

20.1 European contact — INTELLIS CONSEIL

For a transaction concluded with INTELLIS CONSEIL, contractual requests are addressed directly to that company. For a Product return, the applicable logistics address is specified in the Order or case instructions; it may differ from the registered offices above.

The Customer may also use Spectra if they wish to benefit from automated or faster processing of their request.

Use of the chatbot is optional where a legal provision allows the Customer to use another means of communication.

For a complaint, it is recommended to provide the Order number, Customer identity, Product concerned, nature of the request and any information useful for processing it.

Article 21 – Consumer mediation

Before referring a matter to a mediator, the Consumer Customer is invited to submit their complaint directly to Europe-Connection customer service.

Where the dispute has not been resolved through this preliminary step, the Consumer Customer may use the mediation scheme covering their seller free of charge, subject to the applicable admissibility conditions. The mediator must have jurisdiction over the company legally identified in the Order.

The CM2C contact details below relate only to disputes covered by the relevant seller’s mediation agreement. Mention of CM2C in previous Terms does not, by itself, establish another company’s membership or transfer a mediation agreement.

Telephone: +33 1 89 47 00 14
Website: https://www.cm2c.net/

Mediation is free for the consumer, subject to any personal expenses they choose to incur for assistance or representation.

Article 22 – Governing law and competent courts

These Terms are governed by French law.

For a Consumer Customer residing in another country, this clause cannot deprive them of mandatory protection provisions to which they are entitled where those provisions legally apply. In particular, nothing in these Terms excludes or restricts mandatory rights under applicable UK consumer legislation.

In the event of a dispute, the parties are invited first to seek an amicable solution.

The Consumer Customer may also use mediation under the conditions set out in the preceding Article.

If no amicable settlement is reached, the competent court is determined in accordance with the applicable mandatory procedural and consumer protection rules.

No clause in these Terms requires the Consumer Customer to use a court different from one to which they may legally have recourse.

For exclusively business disputes, the applicable jurisdiction rules arise from the law and, where relevant, special terms validly agreed between the parties.

Article 23 – Contractual hierarchy and severability

In the event of a contradiction concerning a particular Product characteristic, the specifications expressly agreed for the Order and confirmed by the seller prevail over a general Product presentation.

Special terms for a Customised Product supplement these Terms.

For Business Customers, the special provisions of an accepted quotation, purchase order or contract prevail over these Terms for matters expressly addressed in that document.

No special provision may, however, exclude a mandatory statutory provision.

If a clause of these Terms is declared void, unlawful or inapplicable, the other clauses remain applicable to the extent that they can operate independently of it.

Article 24 – Withdrawal form

This form is intended only for Orders that legally benefit from the right of withdrawal. It is not intended for a Product legally excluded from that right, in particular where it is goods made to the consumer’s specifications or clearly personalised.

Annex – Reminder concerning Customised Products

Where a Product page includes a customisation field, the Customer is invited to provide the information needed to manufacture their equipment.

Example of information displayed:
“Customise your spy camera to suit your needs! Enter your preferences here (position, housing colour, specific options). Our technicians will review your request and carry out the customisation where possible.”

For models identified as Customised Products, the housing may be opened, dismantled, drilled, machined or modified, and the electronic device may be positioned according to the configuration ordered.

A technician may contact the Customer to confirm the information needed for manufacture.

The Customer is informed before the Order is concluded that, where this work results in goods made to their specifications or clearly personalised within the meaning of Article L.221-28 of the French Consumer Code or the corresponding applicable statutory exception, including the UK Consumer Contracts Regulations 2013 where applicable, the statutory right of withdrawal does not apply.

This exclusion does not affect statutory guarantees in the event of a defect or non-conformity.
